Tinjauan Regulasi Co-Payment pada Produk Asuransi Kesehatan Syariah: Analisis Normatif Seojk Nomor 7 Tahun 2025 dan Kesesuaian Akad Shariah

Penelitian ini bertujuan untuk menganalisis regulasi copayment dalam produk asuransi kesehatan syariah sebagaimana diatur dalam Surat Edaran Otoritas Jasa Keuangan (SEOJK) Nomor 7 Tahun 2025, serta meninjau kesesuaiannya dengan prinsip syariah dan fatwa Dewan Syariah Nasional Majelis Ulama Indonesia (DSN-MUI). Kebijakan co-payment minimal 10% dari total klaim diberlakukan oleh otoritas untuk mengendalikan lonjakan klaim, menekan bahaya moral (moral hazard), dan menjaga keberlanjutan industri asuransi kesehatan. Penelitian ini menggunakan metode kualitatif dengan pendekatan normatif melalui analisis regulasi, fatwa, serta literatur terkait asuransi syariah yang terindeks Scopus. Hasil kajian menunjukkan bahwa skema co-payment pada prinsipnya tidak bertentangan dengan akad tabarru’, wakalah bil ujrah, dan mudharabah selama diterapkan secara transparan, proporsional, serta tidak mengubah substansi tolong-menolong (ta'awun) menjadi mekanisme pengalihan risiko sepihak (risk transfer). Namun demikian, kebijakan ini berpotensi memengaruhi aksesibilitas peserta, terutama bagi masyarakat berpenghasilan rendah, apabila tidak diimbangi dengan perlindungan konsumen yang memadai, sehingga diperlukan integrasi teknologi seperti blockchain dan tata kelola Dewan Pengawas Syariah (DPS) yang adaptif.
